Re: Possible Habeas Jurisdiction over Aliens Held in Guantanamo Bay, Cuba
This memorandum addresses the questino whether a federal district court would properly have jurisdiction to entertain a petition for a writ of habeas corpus filed on behalf of an alien detained at the U.S. naval base at Guantanamo Bay, Cuba.

It was reportedly released by Newsweek Magazine on May 21, 2004, though I have not found the Newsweek page on which that happened. The document shows evidence of having been faxed (particularly on the last page), and having been copied from a 3-hole-punched binder. There is a request for this document from Senator Leahy here:

It says he requested the document from Attorney General Ashcroft in 2004 and has been ignored.
