Commons:Deletion requests/File:Train Collision Odisha.png

This deletion discussion is now closed. Please do not make any edits to this archive. You can read the deletion policy or ask a question at the Village pump. If the circumstances surrounding this file have changed in a notable manner, you may re-nominate this file or ask for it to be undeleted.

This file was initially tagged by Matthiasb as Copyvio (copyvio) and the most recent rationale was: Likely copyrighted work, see water mark. However, the Youtube video which seems to be from the official Kalinga TV account has licensed it as "Creative Commons Attribution license (reuse allowed)." It seems to be in good order, so I am only filing an official "deletion request" to have a definitive decision by the established community process. Fuzheado (talk) 11:04, 3 June 2023 (UTC)[reply]

Keep - Uploader en:Kalinga TV holds the copyrights COM:YT -- DaxServer (talk) 11:34, 3 June 2023 (UTC) Delete as per new comments. It's indeed hard to prove their ownership -- DaxServer (talk) 16:57, 5 June 2023 (UTC)[reply]
Keep - If it's acceptable to chime in as the nominator: the file should be kept as the official Youtube account of Kalingta TV has licensed the video as CC-BY, which allows us to use a screengrab. - Fuzheado (talk) 11:49, 3 June 2023 (UTC)[reply]
Delete - on the basis of the quality of that image used on commons which proves that video itself was not taken by Kalinga TV itself, sure they might own rights to the news story of that video but not every video on it uses in that news segment.. Indian news media are notorious for using other people's videos without attribution and plastering their site's name all over it. If we can see a journalist with a mic talking in front of the crash, only then can we assume they own the rights to that video and thus can release it on whatever right they choose..mind you their website itself is copyrighted..so pretty dodgy..--Stemoc 14:13, 3 June 2023 (UTC)[reply]
Hmm.. that's a valid argument -- DaxServer (talk) 15:48, 3 June 2023 (UTC)[reply]
Weak Keep - Although it's issued by Kalinga TV under CC Attribution so it can be kept for a while. Look for ANI or PTI press agencies' images, which can replace this. Iamrajdeepdas (talk) 15:42, 3 June 2023 (UTC)[reply]
After a bit of "research", I discovered that Kalinga TV had hyperlinked their Terms of Service at the bottom of their homepage until at least March 19, 2023. But even though I couldn't find a hyperlink to the TOS after that, you can still access the TOS by going directly to https://kalingatv.com/terms-of-service/. However, it is unclear to me whether they are still valid, since the hyperlink has been removed from the homepage and the TOS page may have simply been forgotten.
Don't know if this is helpful, just thought I show my findings (don't know a lot about legal stuff). Daniel Maak (talk) 21:57, 3 June 2023 (UTC)[reply]
I am convinced that this image is not owned by Kalinga tv, but by ABP — as may be confirmed by the following image search result https://i.ytimg.com/vi/NqIc6qr7Zt0/maxresdefault.jpg — Preceding unsigned comment added by Carlospt (talk • contribs) 14:27, 4 June 2023 (UTC)[reply]
